To Receive An RMA Number
Please
provide the following
information to

in order to
receive a
Return Merchandise
Authorization, (RMA) number. All
return
requests
must be submitted via E-mail.

equipment may be returned after
use. Some items may not be
returnable after washing,

Terms
and Conditions of Sale
PRICE:
All prices
given here are based upon
manufacturer's pricing to Lions
Restaurant Equipment. ("Lions")
and are subject to change
without notice. Unless otherwise
stated, pricing is F.O.B. at
Lions' or its suppliers'
facilities, and does not include
freight or setup and
installation. Prices are
exclusive of all taxes now in
force or enacted in the future
and therefore subject to an
increase equal to the amount
Lions may be required to collect
or pay associated with the sale
or delivery of items herein.
Modification of this order by
the customer after order
acceptance by Lions may result
in a change in price to reflect
material and labor expenses
incurred by Lions, in making
said modifications.
RETURNS:
In order to
return any product to Lions,
Customer must obtain a Return
Merchandise Authorization (RMA)
number. RMA numbers will be
issued within 30 calendar days
from invoice date. The RMA
number is valid for 15 calendar
days from issue date. Products
received by Lions with an
expired RMA number will be
refused and returned to
Customer. NO returns of any type
will be accepted without an RMA
number. Lions reserves the right
to refuse any return which is
not 100% complete, in resalable
condition (packaging has not
been damaged or defaced), and
includes original packing
material, manuals, blank
warranty cards and other
accessories provided by the
manufacturer. All defective
products may be returned to
Lions for exchange, repair or
replacement, at Lions'
discretion, within the stated
time period. All opened and/or
unopened non-defective returns
for credit or exchange are
subject to a 20% restocking fee
and must be completed within the
stated period. All Freight and
Insurance charges are
non-refundable. Do not
mark/write on or damage the
item's box/carton/packaging.
WARRANTY: The only
applicable warranties will be
provided by the manufacturers of
the equipment listed herein.
Lions will act on the Customer's
behalf with the manufacturers to
obtain warranty service, if
required. If warranty service is
required, Lions shall assist in
upholding Customer's rights
under these warranties,
including labor, at the
prevailing rate. Lions does not
warrant that the operation of
any equipment or of any supplies
will be uninterrupted or error
free. LIONS MAKES NO WARRANTIES
REGARDING ITS PRODUCTS OR
SERVICES (INCLUDING WITHOUT
LIMITATION WARRANTIES AS TO
MERCHANTABILITY AND FITNESS FOR
A PARTICULAR PURPOSE) EITHER
EXPRESSED OR IMPLIED. LIONS
SPECIFICALLY MAKES NO WARRANTIES
AS TO THE SUITABILITY OF THE
PRODUCTS OR SERVICES FOR ANY
PARTICULAR APPLICATION. CUSTOMER
ACKNOWLEDGES THAT IT IS
CUSTOMER'S CHOICE OF EQUIPMENT
OR SUPPLIES THAT IS AND HAS BEEN
THE INSTRUMENTAL FACTOR IN THE
SELECTION OF THE PRODUCTS FOR
PURPOSES AND USES INTENDED BY
THE CUSTOMER. In no event shall
Lions be liable for special,
incidental or consequential
damages in connection with, or
arising out of, the furnishing,
performance or use of any
product or services covered by
this agreement. Responsibility
and/or liability of Lions shall,
in connection with any product
or service, be limited in
maximum amount to the original
purchase price of that product
or service. Customer agrees that
products and equipment shall be
used in manner described by the
original manufacturer thereof,
otherwise any applicable
warranty will become null and
void. Any applicable warranty
does not cover normal wear and
tear and is contingent upon
proper storage, installation,
use and maintenance in
conformance with applicable
recommendations of manufacturer.
PAYMENT: Payment shall be
made with a deposit at the time
of placing the order, with the
remainder upon delivery. Payment
may be made by Mastercard, Visa,
American Express, personal or
company check in advance (some
checks may take up to 5 business
days to clear our bank, Please
note:$28 returned check fee will
be charged to customer for
returned checks) and Money
Order. COD is also available on
most items, $5.50 COD charge is
applicable. COD terms are Money
Order or Certified Check only
(as of September 1998 UPS no
longer will accept cash). Credit
Card transactions are charged in
two ways: for items being
shipped from Lions warehouse,
Lynbrook New York, credit cards
are charged the day that your
items ship; for items being drop
shipped from a manufacturer
warehouse, credit cards are
charged at the time of placing
the order with the shipping
warehouse. Title passes to the
Customer when merchandise is
delivered to the Customer (or
freight carrier) at Lions' or
its suppliers' facilities. If
Lions is to install any system
at the Customer's site, then
title shall pass to the Customer
at the time of delivery. Lions
reserves the right to make
partial shipments. Each shipment
shall be a separate transaction
and payment shall be made
accordingly. If shipments are
delayed by Customer for whatever
reason, payment shall become due
on the originally scheduled
shipment date. Customer hereby
grants to Lions a security
interest in the equipment as
security for the performance by
customer of all its obligations
in this agreement. Customer
agrees to pay any and all
expenses incurred by Lions
associated with the collection
of any monies owed to Lions by
Customer or Customer's agents.
Items refused at "point of
delivery" are subject to a
$20.00 charge .
DELIVERY: Delivery shall
be F.O.B. Lions or its
suppliers' facilities, with
shipping. All deliveries are
SIDEWALK delivery, unless other
arrangements are made by
customer in writing with Lions.
Delivery is not included in
listed prices, all items are
plus freight unless noted
otherwise as part of a promotion
or other package. See Types of
delivery. No setup or
installation is expressed or
implied by Lions on the sale of
any merchandise. Regardless of
whether shipping arrangements
are made by Customer or Lions,
risk of loss shall pass to
Customer upon delivery by Lions
or Lions' supplier, to carrier.
In the absence of specific
written instructions on the face
of this document, Lions will
select the carrier, but shall
not thereby incur any
responsibility or liability in
connection with shipment, nor
shall the carrier be construed
to be an agent of Lions. Lions
shall not be liable for any
damages or penalty for delay in
delivery or for failure to give
notice of delay when such delay
is due to the elements, acts of
God, delays in transportation,
delays in delivery by Lions'
vendors or any other causes
beyond the reasonable control of
Lions. The scheduled delivery
date shall be extended by a
period equal to the time lost
because of any such delay.
TYPES OF DELIVERY:
UPS -
All services (Including
Hundredweight) are available as
per UPS guidelines and
requirements for maximum package
size and weight. On in stock
items, most items ship same day
if order is placed before 12
p.m. EST. Other out of stock or
non-stock items are shipped the
day following their arrival at
Lions.
FEDEX
-
All services are available as
per FEDEX guidelines and
requirements for maximum package
size and weight.
AIRBORNE EXPRESS
- All
services are available as per
AIRBORNE EXPRESS guidelines and
requirements for maximum package
size and weight.
COMMON
CARRIER -
Lions will ship larger orders
"best way" common carrier.
Freight charges will be added to
order and customer will be
advised of such charges before
shipment for confirmation.
UNITED
STATES POSTAL SERVICE
- When
asked, Lions can ship via USPS.
We have found better results and
tracking abilities with UPS and
FEDEX.
DROP
SHIPMENTS -
Some items that are DROP SHIPPED
may be FREIGHT COLLECT to be
paid by customer at moment of
delivery, non-payment of freight
collect does not void sale
terms.
FOR LARGE EQUIPMENT -
ALL LARGE EQUIPMENT IS
SHIPPED COMMON CARRIER. SERVICE
IS TRADITIONALLY "TAILGATE"
SERVICE, IF "LIFT GATE" SERVICE
IS NEEDED IT MUST BE REQUESTED
BY CUSTOMER AND MAY AFFECT END
DELIVERED PRICE. THIS DELIVERY
DOES NOT INCLUDE "INSIDE"
DELIVERY, SET-UP OR REMOVAL OF
OLD EQUIPMENT.
ACCEPTANCE AND USE:
Customer
agrees to accept the listed
equipment, supplies or services
under the terms and conditions
of this agreement. Customer
further agrees, with respect to
equipment and supplies, to
accept responsibility for 1)
their selection to achieve the
Customer's intended results, 2)
their use and 3) the results
obtained therefrom. Customer
also has the responsibility for
the selection and use of, and
results obtained from, any other
equipment, supplies or services
used with the equipment and
supplies. The terms and
conditions of sale contained
herein supersede all agreements
made and purchase orders
submitted to and accepted by
Lions. All sales shall be final
once accepted by Customer. Lions
is under no obligation to refund
or exchange merchandise. Lions
is entitled to reasonable
storage fees for any merchandise
left on its premises. Deposits
or prepayments made prior to
delivery are also non-refundable
unless otherwise noted in
writing by Lions.
Customers Please Note: There may
be some very important matters
to consider before placing an
order for any equipment.
Electric Voltage -
Always supply equipment with the
correct voltage specified by
manufacturer for that item.
Gas -
Please specify and use the
correct type of gas. There is
"natural gas" and bottled gas (aka
"LP" gas or "propane"). The
burners in the equipment have
been set by the manufacturer for
optimum results. Unauthorized or
illegal hookups may VOID
warranty and cause problems with
any fire insurance coverage you
may have.
For
commercial customers: Please
check your local fire code
before ordering any "open flame"
equipment for the need for a
hood or fire suppression system.
Finishes and Options
- Many items
come in a variety of finishes.
Some finishes may be more
expensive than others. Therefore
any change in finish selection
may cause a change in sale
price. Some items may require
customer to "sign off" on a
proof copy of a drawing of the
item to be purchased. Deposits
on custom items are
NONREFUNDABLE and custom items
are NONRETURNABLE, so PLEASE,
order these items with care.
Size of
Equipment
- Some larger
items may require minimum door
or side clearances for physical
entry into a building or room or
for safety in use in the case of
cooking equipment.
Lead
Time
- Some stock,
non-stock or special orders may
require a certain amount of lead
time before delivery. Lead time
may vary item to item. Any ship
dates on these items are an
estimate to the best of our
ability. Lions cannot be held
responsible for unforseen delays
in delivery due to delay in
production by a manufacturer or
in delay of shipment by a
manufacturer or shipping agent
for any reason such as labor
strike or raw material shortage.
It is the customers
responsibility to make sure that
items are ordered as to allow
for sufficient time for all
factors that may delay delivery
before the items may be required
for actual use by said customer.
All
matters pertaining to this
agreement shall be governed by
the laws of the State of New
York. |
